Southern Montana trustee asks court to set Feb. 15 as plan-filing date

By Caroline Salls

Pittsburgh, Nov. 6 - Southern Montana Electric Generation and Transmission Cooperative, Inc.'s Chapter 11 trustee has asked the U.S. Bankruptcy Court for the District of Montana to fix Feb. 15 as the date for the trustee and other interested parties to file a plan of reorganization and disclosure statement for the company's bankruptcy case, according to a Monday filing.

As previously reported, trustee Lee A. Freeman has asked the court to extend the deadline for selecting a plan proposal to Dec. 14 from Nov. 16.

According to Tuesday's motion, the trustee believes that the next logical step at this stage of the process is to establish a plan submission and confirmation timetable to further advance the reorganization process.

"Also, because other plans of reorganization in addition to the trustee's plan may be filed, it is desirable to establish an orderly and transparent process under which all parties-in-interest will have an opportunity to participate," Freeman's motion said.

Billings, Mont.-based Southern Montana filed for bankruptcy on Oct. 21, 2011. Its Chapter 11 case number is 11-62031.
