RMH Franchise requests precautionary two-month exclusivity extension

Pittsburgh, Oct. 30 – RMH Franchise Holdings, Inc. asked the U.S. Bankruptcy Court for the District of Delaware to extend its exclusive periods during which only the company can file a Chapter 11 plan and solicit votes on the plan, according to a motion filed Monday.

The proposed extended plan-filing deadline would be Jan. 18, marking a 60-day extension, and the solicitation deadline would be March 5.

As previously reported, the disclosure statement for the plan RMH filed in September was approved by the court on Oct. 15.

The company said it has since begun to solicit plan votes. The plan confirmation hearing is scheduled for Nov. 19, the same day as the expiration of the current exclusive plan-filing period.

As a result, RMH said it is seeking an extension “out of an abundance of caution” to preserve its opportunity to make any necessary amendments to the plan and solicit acceptances “without the distraction of competing plans.”

A hearing on the exclusivity extension motion is scheduled for Nov. 19.

RMH is an Atlanta-based Applebee’s franchisee. The company filed for bankruptcy on May 8 under Chapter 11 case number 18-11092.
