Rotech eyes extension of plan exclusive periods while soliciting votes

Wilmington, Del., Aug. 6 - Rotech Healthcare Inc. is seeking a four-month extension of its exclusive periods for filing a Chapter 11 plan and for soliciting plan acceptances, according to an Aug. 6 filing with the U.S. Bankruptcy Court for the District of Delaware.

Although Rotech has filed a plan and began soliciting acceptances, "the extensions sought herein may not provide sufficient time for the debtors to complete the various tasks that may need to be completed before the plan can be confirmed," the debtor's motion stated.

A plan confirmation hearing is scheduled for 10 a.m. ET on Aug. 29.

If the request is granted, the exclusive period for filing a plan would be extended through Dec. 4 from Aug. 6. The exclusive period for soliciting votes would be extended through Feb. 2, 2014 from Oct. 4.

A hearing on the request is scheduled for 11 a.m. ET on Sept. 19.

Under local rules in Delaware, the exclusive periods are automatically extended through the date of the hearing on the request.

Rotech, an Orlando, Fla.-based provider of home medical equipment and related products and services, filed for bankruptcy on April 8. Its Chapter 11 case number is 13-10741.
