Merrill Lynch to issue notes linked to Topix Small Cap index

Chicago, Nov. 16 - Merrill Lynch & Co., Inc. plans to price zero-coupon notes due January 2009 linked to the Topix Small Cap index, according to a FWP filing with the Securities and Exchange Commission.

Payout at maturity will be par plus quadruple any index gain, capped at a return of between 23% and 27%. The exact cap will be set at pricing.

Investors will be exposed to any decline in the index.

The notes are expected to price and settle in November.

Merrill Lynch & Co. will be the underwriter.
