Dean Foods seeks fourth extension of exclusive plan periods

Olympia, Wash., Oct. 13 – Dean Foods Co. is seeking a fourth extension of its exclusive periods to file and solicit votes on a Chapter 11 plan, according to a motion filed Monday with the U.S. Bankruptcy Court for the Southern District of Texas.

The debtors are seeking to extend the plan filing period through Nov. 26 from Oct. 12 and the solicitation period through Jan. 25 from Dec. 11, provided that upon written consent from the committee, the plan filing period will automatically be extended through Dec. 21 and the solicitation period through Feb. 19.

“The debtors and the committee continue to work together constructively to formulate a confirmable Chapter 11 plan that would maximize distributable value to the debtors’ creditors,” the motion said.

“In doing so, the debtors and the committee believe that they have narrowed the issues and hope to file a Chapter 11 plan and disclosure statement within the next several weeks.”

A hearing is scheduled for Nov. 16.

Dean Foods is a Dallas-based food and beverage company. The company filed bankruptcy on Nov. 12, 2019 under Chapter 11 case number 19-36313.
