DBSD North America eyes exclusivity extension to await FCC licensing

By Caroline Salls

Pittsburgh, Jan. 14 - DBSD North America, Inc. requested an extension to its exclusive period for soliciting votes on a plan of reorganization, according to a Wednesday filing with the U.S. Bankruptcy Court for the Southern District of New York.

Specifically, the company wants to extend its exclusive solicitation period to June 9 from Feb. 9.

As previously reported, the company's plan of reorganization has already been confirmed.

However, DBSD said the plan cannot take effect until the Federal Communications Commission approves its application to transfer licenses to the reorganized company.

The company said it filed its FCC application on Dec. 11, but the licensing process usually takes four to six months.

A hearing is scheduled for Jan. 28.

DBSD is a subsidiary of ICO Global Communications (Holdings) Ltd., a Reston, Va., mobile satellite services company. The subsidiary filed for bankruptcy on May 15, 2009. Its Chapter 11 case number is 09-13061.
