Hawaii Structural Ironworkers Pension Trust Fund asks court to certify $60 million claim against Calpine

Portland, Ore., June 8 - The Hawaii Structural Ironworkers Pension Trust Fund asked the court to certify its claim of at least $60 million in damages against Calpine Corp., according to a Friday filing with the U.S. Bankruptcy Court for the Southern District of New York.

According to the motion, the Hawaii Structural Ironworkers Pension Trust Fund filed a proof of claim against Calpine in August 2006 for damages previously alleged in a class action lawsuit that claimed Calpine used a materially false and misleading registration statement in connection with its April 2002 stock offering.

The Hawaii Structural Ironworkers Pension Trust Fund represents all persons who purchased Calpine common stock between April 24, 2002 and March 3, 2003, according to the motion.

A hearing has been scheduled for June 26.

Calpine, a San Jose, Calif., power company, filed for bankruptcy on Dec. 20, 2005. Its Chapter 11 case number is 05-60200.
