Cyxtera receives 120-day extension of exclusive plan periods

By Sarah Lizee

Olympia, Wash., Sept. 22 – Cyxtera received a 120-day extension of its exclusive periods to file and solicit votes on a Chapter 11 plan, according to an order filed Thursday with the U.S. Bankruptcy Court for the District of New Jersey.

The exclusive plan filing period was extended through Jan. 30 and the exclusive solicitation period was extended through April 1, 2024.

“The debtors’ progress to date has been achieved in no small part due to the breathing room provided by the exclusivity afforded to debtors-in-possession in Chapter 11,” the company said in its motion seeking the extension.

“The debtors believe that maintaining their exclusive right to file and solicit votes on a plan is critical to their ability to complete a value-maximizing process and achieve their remaining restructuring goals.”

Cyxtera is a data center firm based in Coral Gables, Fla. The company filed bankruptcy on May 4 under Chapter 11 case number 23-14853.
