Crescent Oil requests sixth extension to file a plan, solicit votes

By Lisa Kerner

Charlotte, N.C., May 3 - Crescent Oil Co. Inc. requested a sixth extension to its exclusive periods to file a plan of reorganization and solicit votes on the plan, according to a Monday filing with the U.S. Bankruptcy Court for the District of Kansas.

The company wants to extend its exclusive filing period by 90 days to Aug. 9 from May 9 and the solicitation period to Oct. 8 from July 9.

Crescent said in the motion the extension "is intended to afford debtors the opportunity to determine how they wish to proceed with the captioned cases post-sale, including but not limited to proposing a viable plan and submitting a comprehensive disclosure statement."

The company sold its assets in September, the filing said.

Crescent Oil, an Independence, Kan.-based fuel distributor, filed for bankruptcy on Feb. 7, 2009. Its Chapter 11 case number is 09-20258.
