Birch Telecom requests 45-day exclusivity extension to complete solicitation process

Pittsburgh, March 8 - Birch Telecom, Inc. requested a 45-day extension to its exclusive periods to file a plan of reorganization and solicit votes on the plan, according to a Wednesday filing with the U.S. Bankruptcy Court for the District of Delaware.

The company wants to extend its exclusive plan filing period to April 24 from March 10 and the solicitation period to June 23 from May 9.

According to the motion, the extension request is a precautionary measure to give the company additional time to complete the solicitation process for its already approved disclosure statement and to confirm the plan.

A hearing is scheduled for March 30.

Birch, a Kansas City, Mo.-based comprehensive voice and data services company, filed for bankruptcy on Aug. 12, 2005. Its Chapter 11 case number is 05-12237.
