Amyris secures 90-day extension of exclusive plan periods

By Sarah Lizee

Olympia, Wash., Jan. 8 – Amyris, Inc. received a 90-day extension of its exclusive periods to file and solicit votes on a Chapter 11 plan, according to an order filed Friday with the U.S. Bankruptcy Court for the District of Delaware.

The court extended the exclusive plan filing period through March 6 and the exclusive solicitation period through May 6.

As previously reported, the company has filed a Chapter 11 plan and received approval of the related disclosure statement. The plan confirmation hearing is scheduled for Jan. 24.

“Continued exclusivity will permit the debtors to maintain flexibility so that a competing plan by another third party does not derail the parties’ efforts towards a plan process,” the company said in the exclusivity motion.

“All stakeholders will benefit from such continued stability and predictability.”

Emeryville, Calif.-based Amyris is a synthetic biotechnology company. The company filed bankruptcy on Aug. 9 under Chapter 11 case number 23-11131.
