American Restaurant ordered to file a fifth disclosure statement and plan

Houston, Feb. 14 - American Restaurant Group, Inc. must file a fifth amended disclosure statement and plan of reorganization by Feb. 18, said Thomas Donovan, the judge for its Chapter 11 case, in a filing Feb. 10.

Responses to the amended statement must be filed by March 4 and a hearing on the plan will be held on March 10.

The Los Altos, Calif.-based restaurant company's fourth amended disclosure statement and plan of reorganization was criticized by the official committee of unsecured creditors as suffering from many of the same failings as the earlier documents - which were rejected by the court.

American Restaurant filed for Chapter 11 on Sept. 28, 2004 in the U.S. Bankruptcy Court for the Central District of California. Its case number is 04-30732.
