Allied Holdings' equity holders request to quash Yucaipa subpoenas denied

Pittsburgh, March 30 - Allied Holdings, Inc.'s informal equity committee's motion to quash subpoenas issued by The Yucaipa Cos. LLC was denied Friday by the U.S. Bankruptcy Court for the Northern District of Georgia.

According to the motion, the subpoenas requested production of a wide range of documents on less than five business days' notice.

In addition, the committee said the subpoenas were issued by an entity called The Yucaipa Cos. LLC, which claimed to be a defendant and referred to the committee members as plaintiffs, although no adversary proceeding has been filed.

The committee said the goal of Yucaipa's premature recovery requests "is an attempt to frustrate the ad hoc committee's ability to properly respond to the plan and/or disclosure statement," if the committee decides to respond or object to either document.

Allied, a Decatur, Ga., distributor of new and used vehicles, filed for bankruptcy on Aug. 1, 2005. Its Chapter 11 case number is 05-12515.
